1. AVNI MATRIMONY IS THE REGISTERED TRADE MARK OF VR INTERMEDIARY(I) PVT LTD. ONCE YOU USE THE PLATFORM (WEBSITE AND/OR MOBILE APP.) OF AVNI MATRIMONY (HEREIN AFTER REFERRED AS AM)IT WILL BE IMPLIED THAT YOU HAVE READ THE TERMS AND CONDITIONS OF AM VERY CAREFULLY,UNDERSTOOD IT AND UNEQUIVOCALLY ACCEPTED AND AGREED TO ABIDE BY THE SAME.
2. THEREFORE, PLEASE READ THE TERMS AND CONDITIONS OF AM VERY CAREFULLY BEFORE USING THE PLATFORM.
3. IF YOU DONOT ACCEPT THE TERMS AND CONDITIONS OF AM, YOU SHOULD NOT USE THE PLATFORM OF AM, OTHERWISE YOUR AGREEMENT WILL BE IMPLIED TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DONOT WANT TO BE BOUND BY THE TERMS AND CONDITIONS YOU MUST NOT USE THE PLATFORM OF AM. USERS OF PLATFORM OF AM ALLOW THE COMPANY TO FIND SUITABLE CANDIDATE ON THEIR BEHALF FOR MATRIMONIAL PURPOSE.
4. AM PROVIDE IT’S SERVICES AND PRODUCTS TO YOU ON THE CONDITION THAT YOU ABIDE BY THESE TERMS AND CONDITIONS AS AMENDED AND UPDATED FROM TIME TO TIME. THESE TERMS AND CONDITIONS ALSO INCLUDE THE APPLICABLE POLICIES LIKE PRIVACY POLICY, REFUND POLICY ETC. AS AMENDED FROM TIME TO TIME.
5. All the interested individuals must furnish the required information for on line registration along with recent photographs. These are the basic information which form the basis for their matrimonial alliance, so it must be true, correct and accurate. If demanded, the individual concerned will furnish photocopies of the certificates etc. in support of the information furnished by him.
6. Duplicate registration is not allowed.
7.The platform is meant to be used by individuals only and no company or organisation etc. can become the member of AM.
8. All the interested individual would also furnish their preferred parameters, they are looking for in the prospective match, like educational qualification, annual income etc. so that, as far as possible, the details of such preferred candidates could be provided for their consideration. However, there could be variations between your preference and the profiles of the candidates provided to you for consideration. Such variations will not form the basis for any dispute.
9. In case the information provided by you is found to be false or selfcontradictory, AM reserves the right to block your registration profile and also terminate your membership. The membership fee paid in such cases shall stand forfeited. Further furnishing of false information constitute fraud and may also attract legal action.
10. To register as a member of AM, a person must be :
i) Indian citizen having some proof of their identity like valid Indian driving licence, aadhar card, bank account in India, Indian Passport or the like. NRI, PIO, Person of Indian descent or heritage, persons who are having proof of their identity and intend to marry PIO can also register themselves as a member of PM
ii) Legally competent to marry.
iii) Have attained marriageable age as per Indian law( as amended from time to time) at the time of registration with AM . Presently it is 18 yrs. for female and 21 yrs. for male
iv) If he is himself is not a candidate and applies on behalf of others, he must have right , consent, authority and legal capacity to enter into an agreement on behalf of the applicant ,with AM and submit relevant information to AM .
11. All those who have registered with AM must confirm that they intend to use the platform for a bonafide purpose of matrimonial alliance only and not for casual dating or contact website or any other similar purpose.
12. AM acts as an intermediary as defined under clause(1) sub clause (w) of Section 2 of Information Technology Act 2000. AVNI MATRIMONY is run and managed by V R Intermediary (I) Pvt Ltd. PM website URL www.avnimatrimony.com and mobile applications on playstore (Android) and IOS (Apple) are hereinafter collectively referred as “ Platform”.
These terms and conditions, privacy policy and Rules and regulations user agreement for access or usage are being published in accordance with the provisions of Rule 3(1) of Information Technology (Intermediary guidelines) Rules 2011. Further under provisions of Rule 3(2), the users are informed not to host, display, upload, modify, publish, transmit, update or share any information contained in sub-para (a) to (i) of Rule 3(2) of I T (intermediary) guidelines Rule 2011, that :-
(a) belongs to another person and to which the user does not have any right to;
(b) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner.
(c) harm minors in any way.
(d) infringes any patent, trademark, copyright or other proprietary rights.
(e) violates any law for the time being in force;
(f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
(g) impersonate another person.
(h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
(i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relation with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.
It is further informed that AM is bound to follow the said Rules, Provisions of the Act or any other laws for time being in force strictly and if any of the provisions of said Rules are not contained in terms and conditions, the said Rules shall prevail over these terms and conditions. In such or similar circumstances, AM at it’s sole discretion may terminate or restrict or block the user’s access to the platform without any notice to the user and AM reserve the right to initiate prosecution under the law or take similar action
14. Personal information/data submitted by you for matrimonial purpose will be treated as confidential and will be governed by the privacy policy of AM. It is implied that you have agreed to transfer these personal information/data to be used for matrimonial and related purpose only, by others and your consent is free, specific, informed, unconditional and unambiguous. Further you have a right to withdraw your consent at any time. If you do not wish your information/data to be transferred or used by others for matrimonial and related purposes, you should NOT use the AM Platform. Your feedback shall not be confidential.
15. Posting, distributing or reproducing in any way any of the copyright material, trademark or other proprietary information of AM, without obtaining prior written consent of AM is prohibited. If at all it is believed by any person that his/her work has been copied and posted on PM which constitute copyright infringement,Notice of such claim of copyright infringement can be sent by the owner in writing to AM on the address given under Contact us/ customer care section of the site.
16. Individual himself/herself shall be responsible for maintaining and safeguarding the confidentiality of their AM log in credentials and shall be solely responsible for all activities that occur under their account and for restricting access to their computer or mobile to prevent unauthorised access to their account.
17. All payments would be accepted in accordance with the RBI guidelines, as amended from time to time. AM collects payments through the third party payment gateway through payment instruments like UPI, debit/credit card, NEFT/ RTGS, Net banking etc. AM services will be activated only after realization of such payments. Unpaid registration will not be provided with any of the PM services. – All payments should be made only to AM account and not to any employee of AM. If done so, AM will not be responsible for the same under any circumstances.
19. In the event of termination of your membership by AM for violation of any of the provisions of terms and conditions, all amount paid by you till date shall be forfeited.
20. Failure in payment gateway, extra currency, conversion charges, deductions error issues etc. from payment gateway shall not be responsibility of the company..
21. Refund if any, under exceptional circumstances like winding up of the company etc. will be at the sole discretion of the company/ payment gateway. The company offers no guarantee for refund.
22. AM cannot be and will not be responsible or liable for any action of members or third party over which AM has no control. For such actions the individual concerned will himself/herself be personally responsible and liable for action and NOT AM. It is difficult to summarise all such actions. However efforts have been made to enlist a few of them. This list is only illustrative and not exhaustive : -
i) of AM must refrain from violating any law in force in India for the time being, using abusive language, entering into physical relationship or financial transactions with other PM members, being discriminative or using racial comments, mention details of other matrimonial services while sending messages or any similar messages or comments which may be offensive or even irritating or unpleasant for others.
(ii) Under no circumstances, AM or it’s office bearers shall be responsible or liable to the AM members /his or her authorised representative/ Registrant/third party for any direct, indirect, consequential, incidental, special exemplary or punitive damage of any character without limitation, damages resulting from the use of AM platform/services or third party website.
iii) The exchange of matrimonial profile(s) through AM platform should not in any way be construed as a matrimonial offer or recommendation from AM.
iv) PM will not be liable for any AM member not responding/reciprocating for matrimonial alliance or for wrong/improper match made due to unavailability of desired profiles or for the AM members entering into financial transactions/ physical relations with other members or third party.
v) AM shall not be liable or responsible for any loss or damage arising out of or subsequent to matrimonial relations established pursuant to use of the services provided by AM
vi) AM does not authenticate or take responsibility for the correctness of the information furnished by the members, as AM does not investigate in to any such information.
vii) Due diligence, initiative and efforts must be exercised by those wishing to use any information found on platform, and should take proper and adequate precautions with full and complete knowledge because all information contained on the platform have been placed directly by the users without investigation by the AM viii) AM shall not be responsible or liable for any technical malfunctioning of any communication lines which may be interrupted or suspended for the reasons beyond the control of AM
ix) AM has a right to ensure that the platform is operated properly and in accordance with the instructions issued by the Govt. of India from time to time. AM reserves the right to refuse to post or remove information or materials in whole or in part thereof, which in its sole discretion are not acceptable, undesirable or in violation of the laws of the land.
x) You expressly agree that AM services are provided on “As available “ and “As is” basis as AM does not investigate into any such information provided by the user, and AM assumes no responsibility for any error , omission, interruption, defect, delay in operation or transmission, deletion, communication line failure or for any incorrect or false contents posted on the site by the user.
xi) You expressly agree that your use of AM platform is at your sole risk and under no circumstances AM will be responsible for any loss or damage resulting from cybercrimes or anyone’s use of site platform which may not be free from viruses etc.
23.Users hereby agree and consent for receiving communication through any medium of communication like email, SMS, WhatsApp, messages or telephone calls.
24. By using AM services, the users have agreed to indemnify AM from any loss etc. So users shall indemnify and hold AM, its officers, agents, partners and employees fully indemnify and harmless from any loss, liability, claim or demand including attorney’s fees, made by any third party due to or arising out of your use of services in violation of the agreement and /or from a breach of these terms and conditions of use of platform, or display of unauthorised, forged, or manipulated on the platform or any fraudulent act on your part. This defence and indemnification obligation will survive in perpetuity.
25. With the changing needs of the society, the laws of India relating to I. Technology, financial transactions and other social rules also keep on changing. The terms and conditions of AM shall be treated as amended, added, deleted or replaced by the changing laws of India without any notice.
26. 28. Any dispute between members and AM will first be resolved through mediation, failing which by the competent court of law situated in Delhi only. The members agree unconditionally that all such disputes will be governed by the laws of India.
